Terms and Conditions

I have read and understood the Terms & Conditions and accept the prices quoted, and confirm that I am authorized to accept them on behalf of all other persons included in this booking.

TERMS & CONDITIONS

(A)	THE CONTRACT
	The person who signs the booking form does so on behalf of him/herself and all other individuals included in it which means that all are bound with the booking conditions. All bookings are made with M/s UPTOURS U.P. State Tourism Development Corporation Ltd., Hotel Gomti, 6 Sapru Marg, Lucknow-226001 (a Government of U.P. Undertaking).
(B)	PAYMENT/ACCEPTANCE OF BOOKING
	For booking, an advance of 50 percent of the total package cost is to be remitted by Banker's Cheque/Banker's demand draft in favour of M/s UPTOURS U.P. State Tourism Development Corporation Ltd., Hotel Gomti, 6 Sapru Marg, Lucknow-226001 at the time of booking. The balance of 50 percent payment to be remitted to the agency 30 days prior to the commencement of the journey.
(C)	CANCELLATION & REFUND
	However, if the tour is cancelled by the client within 30 days of booking, a nominal cancellation charges of 20% will be deducted from the advance deposited with the agency. If the booking is cancelled by the client before 15 days or less than 15 days of commencement of the journey, it will be treated as "NO SHOW" and "NO REFUND" will be made. Refund, if any, must be applied for within three months of the date of tour.
(D)	CHANGES
	The Company reserves the right to change/modify any of the facilities/service or prices described.
(E)	FACTORS OUTSIDE THE COMPANY'S CONTROL
	The company will do its best to minimise the effects of matters outside its control but cannot accept any liability for these matters which include political disputes, disturbances, border closures, refusal of visa, industrial action, delayed flights, climate, accident, injuries and loss of baggage. Clients will be responsible for his/her insurance while traveling up to the limits which the clients may require. The insurance must cover personal accident, medial expenses, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience causing to the client.
(F)	LIMITATION OF LIABILITY
	The company M/s UPTOURS U.P. State Tourism Development Corporation Ltd., Hotel Gomti, 6 Sapru Marg, Lucknow-226001 shall not be liable for any damage or loss if the failure to carry out the contract is:
	1. attributable to the client.
	2. attributable to a third party unconnected with the provision of the services contracted for and the event is unforeseeable of unavoidable.
	3. due to unforeseen and unusual circumstances beyond the company's control, the consequences of which could not have been avoided even if all due card had to be exercised
	4. due to political disputes, disturbances, border closures, refusal of visas, industrial action/climate or other matters of a similar nature.
	5. due to an event which the company, even with all due care could not foresee or forestall.
(G)	PACKAGE PRICE
	The package price is subject to change without notice specially in cases of enhancement of fuel price, change of exchange rate and any other unforeseen contingency.
(H)	TAXES
	All taxes such as expenditure tax, luxury tax service tax, etc. are not included in the package cost. The same will be collected extra as applicable then.
(I)	CONTRACT/DISPUTE
	The contract is to be construed and any dispute between the parties determined, under the laws of India . Any such dispute shall be subject to the sole jurisdiction of the court of India Lucknow.
